Jackson had refused to discuss a Hobbit film until the case was settled but New Line said it now wanted to move on as it had "limited time" to make the film.
Sure, I had a few problems with some decisions Jackson made in the adaptations of LotR, but overall they were fantastic. I hope the management responsible for this decision at New Line realizes what they are doing and doesn't screw up production...

Initially, I thought this was a rash decision on the part of New Line Cinema; however, from an economical view, New Line is on steady ground. The franchise is well enough established that as long as a production is Tolkein, it will sell the tickets--regardless of the director. And we all know that Hollywood is, unfortunately, ruled by economics.
Unfortunately I think that in the grand scheme of things you may be right. But I think it will hurt them somewhat.
